Here is my situation:
I-140 approved and about to file 485.
Employer says he can file only 485 and no EAD for me. But he can file EAD/AP for my wife.
Can I file EAD/AP for me separately on my own? What are the consequences from my employer if I quit after six months of applying 485 (by that time I would've got my EAD/AP)? Can he reject my 140 and/or 485?
You can apply for EAD at anytime. All you will need is a copy of your I-485 AOS receipt (which I think USCIS will send to you, but I am not sure).
After 6 months (180 days to be exact), your employer cannot revoke I-140 (and hence I-485) if you invoke AC21.

The backlog centers have 10 fed govt employees and 100 guys from Exceed unless I am egregiously mistaken.
Why does any one think that those 100 guys will be left out with out any jobs? Wont the 10 fed guys be moved to Chicago/Atlanta NPC's with huge reloc benefits package? If they dont choose to move because of personal reasons, Do you know what kind of severance packages they get?
100 guys from Exceed will be definitely working for other fed agencies after they are done with this gig. IRS has a huge base in Philly and Exceed is a govt contractor. May be IT consultants need to learn from these folks..

If one is in their say 5th or 6th yr of H1 and has an Approved I-140 (copy) from a company A, does that mean:
1. that he can transfer his H1b to a company B and get 3 yr ext.
2. Again in the 8th or 9th year, can he move to another company C and get a 3 ext (upto 12th year).
So can one get infinite 3 yr extenstions just because once upon a time he/she had an approved I 140 from one of his ex-employers (and not his immediate previous emplyer). :)

Okay, I applied for an H1 transfer late June 2006 on my own. Started at new job after receipt. Late August went on maternity leave. Came back to work in December. During maternity leave, my application was sent back due to wrong fee and no LCA (I didn't use a lawyer and was given somewhat bad advice.) By the time I did a re-application for transfer it was April 2007 (with the help of lawyers, this time). My H1 expired (6 years) near the end of June. But I was told I was okay as long as I was pending. Mid-July got a request for evidence with a date of September 20th being the latest date I can send in the evidence...pay stubs, tax returns, etc.
1. Am I currently out of status or okay because of the RFE?
2. If I apply for F-1 status now (thinking of a second Masters or PhD) will I need to send in the evidence for the H1B before that or will that not matter? It will take me a while to get all of the evidence, but I don't have time to wait in regards to getting the F-1 for school this Fall.
My lawyers suggested leaving the country, but I am fearful of that? Any suggestions, answers, advice?

I find that fireworks mx is really cool for doing what you are trying to do if you can get your hands on it. Oh yeah and I think you should antialias the text a little bit. If you want honest opinions....I think the image could use a little jazzing up....Try this:
Find a nice big panoramic image like of a beach or something.. Then give it a real big gaussian blur (so that you cannt recoginze what it was)......U should already notice it looks similar to a gradient. 2. The give it a strong motion blur to the left or right (to soften the image) 3. Then do a an adjustment...hue.....and play with the saturation and settings. (You should have a pretty nice gradient looking abstract at this point). 4. Then duplicate the layer and play with that layers blend mode. I find luminosity to be cool but find one to suit your needs. That will make your text and image seem more interesting....right now it looks kinda dead in the water......I find gradients by themselves to be boring this day in age (most of the time). Let me know if you need a more indepth tutorial....this one was kinda weak but....hey

Hey, me and my spouse's case also received by NSC on 8/15. Both our EAD status is "Case pending and received". What were your dates? Mine were:
EAD recieved 8/15 notice date 10/11 from NSC.
Please let me know, I am waiting impatiently since I am to start job on Nov 1st!

The question I meant to ask is about the the time that I am not physically present in US i.e. If I went for vacction in India for a month, can that one month be included in my H1B1 extension since I was not physically present in US. In other words I would file for 1.1 year extension as opposed to 1 year
One the same topic, a friend of mine got a three year extension post 6 years of H1B. When asked, his lawyer informed, if you have an approved I140 then you are elegible for 3 years extension as opposed to 1 year. Is this true. Can some refer to the right CFR's

hi All,
I am on AP/EAD and need to Transit thru Paris in February. I have a confirmed return ticket and my visas have expired. I am currently in India.I called VFS and they told me that I do not need a transit visa however when I emailed them they responded by saying check with your Airline. I am trying to email the consulate in Mumbai but keep getting bounce backs.
However I found links on the Atlanta and Washigton consulates that say that I need a visa.

Has anyone returned to the US recently on a Advance Parole and expired Visa? and did you need a Transit visa? It would be great if you can tell when you returned. Immigrationvoice seems to be the only place where I could possibly get some real answers.

As far as I know, transit visa is required in case you do not have a valid visa/ citizenship for the departure country. So, if your visa has expired on passport but have visa approval/ or other documents to support AND you are traveling from US to India via France then you would need France airport transit visa.
However, in your case, since you are Indian citizen (I assume) and traveling to US via France you do not need a airport transit visa.
The logic behind this weird rule is that in case you are stuck in France for some reason and they want you to go home (deport) then you should have valid visa/ citizenship to the country you came from.
Otherwise, none of us (Indians or other nationals) would need a transit visa to Europe going from US - India as we have Indian passport.
Hope this helps. As you know you can always check with airlines/ consulate to make sure you are good to go.
