Filed 485 in vermont service center

I sent my application to vermont based on the USCIS answering system on June 30th that folks with approved I-140s should send 485 applications to the center where it was approved. Any ideas, if there is a problem with that and if the app gets transferred how much time it will take.
anyone else in the same boat?

Is that all he said? I wonder why he did not say they should be screened for their skin color, their Shakespearean English and BTW all the applications of legal residents and naturalized Citizens here who are non Europeans ought to be revisited to ensure they fit the new criteria. Perhaps actually saying that would have been too politically incorrect.
This guy is unbelievably anti-immigrant. Even many anti-immigrants feel he is too far to their right on this issue. Him in the house and Sen. Jeff Sessions in the Senate cannot be changed. They are rather openly vile, vicious and virulent in their attack of any and all immigrants.............legal or illegal. That is why they are given so much airtime on CNN with Lou Dobbs.
The real irony of it all to me is that the ancestors of many of the Mexicans (albeit illegal) immigrants crossing the southern border are indigenous people of the Americas (the new world) like Mayans and Aztecs (atleast in part). His (Tancredo's) predecessors on the other hand are "invaders" like he terms todays immigrants. I wish one day his kind of people who seem like they feel America is their divine gift from god get asked this question in a public forum.
I have yet to meet 1 citizen who speaks Shakespearean English... it certainly won't be anyone on Fox!

and wat about all those desi who work with consultancy who stay on bench etc etc ... where does Oct 2nd/ gone for them..,..? I am sure people who cursed me were one of them !
Infact ateast I am open and willing to ask people before taking any unethical step or wrong step...!

Don't worry...I my self got RFE(For EVL),My wife got for Birth Certificate and for my son(I-693 missing section 3)...we got it for three diff reason.Just submit what ever they requested..and good luck.

I think the only way you can get a second PERM approved for same employee at same company, is if the second position is "significantly different" from the first position. E.g., at least a different job title and different job description, but ideally completely different o*net code. Note that your problem will be with DoL at the LC stage, not USCIS at the I-140 stage. DoL will not approve a second PERM app for same employee at same company if position is substantially similar.
You *might* be able to get approval for a second PERM with similar job description if you completely withdraw the first PERM. I'm not sure if you can withdraw a PERM certification after its been used for an I-140 though.
With trickier cases like this, I've always found it helpful to get second and sometimes third opinions from attorneys at other firms.

Doing smart things like this may get you deported from the US without any chance of return for 5 years . Be honest and follow the law .It against the law to work in one country and get paid in another .
Thanks for the reply. We didn't really work. But my spouse came here in 2003 march. Then she was in vacation for next 1 year the finally resigned. Indian employer gave relieving letter in April 2004. So Practically is my spouse an employee of indian compnay until Apr 2004 and can it be shown towards the experience? That's it.

RFE for Dependent - To show the valid status from day of entery till we filed I 485
One of the supporting document is I-94, but we gave at port of departure.
We have the second I-94 which we received while coming back. Is this copy good enough or do we need to get the second copy.
any body with similar experience please share your thoughts.

My documents will reach attorney on Monday and he promised to file before July4.
Good lawyer...mine is taking 6-7 business days after submission atleast. Though, I did not fill any forms, I filled a questionairre and she will use that to fill the forms, that might delay things a little.

Pls don't get me wrong but when your prior understanding was that You will join his company in near future, based on which he agreed to file your I-140 even if you have paid, why do you don't want to go by your word?
I know employers suck people like us here for GC, etc. but we as employees should also go by our word. If you stay on your decision to join his company now since I-140 is approved, you won't end up having complications at all.
Besides, it is give-and-take and at the most, you will have to work for a year or so with him.

Thanks for your responses. The hospital staff told us it would take 60-90 days to get the SSN. I am stuck until that arrives because only then can I apply for the passport. Any way to get around it?
Call SS office they may give SS on phone or just go and ask them they will give you the number based on which you can apply for passport.
If you apply PIO in person and pick it up in person It will take around week.

1. AC21 - get it all done with new company ? Job title from Sr.Qa to SAP BI would it be a problem?
If any RFE comes, new company should be able to support as per job description/title in Labor which they won't I believe.
2. Temporary resignation and rejoining - is it really feasible?
I don't think you need to resign something in particular.
You can work with SAP company and when your date is becoming current move to QA Company and you should be good. Its like filing AC-21 to SAP company and again filing AC-21 to QA Company.
I know lot of people do this who are working on EAD. Generally you know your date will be current in next year. So you can work for SAP untill June/july-2011 and then move back to QA Company before date becomes current.
3. Stay with current company - try for contract positions even if it means that I have to stay long on bench. I have been already out since Aug.
Your choice and lets wait for some Guru's answers.

But 10 years is a long time to wait on a temporary visa to get your social security back.. There were some discussions to reduce this to 3 years but that talk is dead now.
In India, the best part is 100% compulsory employer contribution. But
Indian PF sucks with rising inflation and lack of accountability.
And we all know how the employers would "Package" their "contribution".
This latest development will sting Indian origin GC holders and US citizens who go back to work in India and MNC employees working abroad.

I am in the same boat as you. My EAD expires on Sept 12th. Still no response from NSC center. I have few friends that I know, who filed after I did and they all have recieved their EADs. Not sure whats going on.
I would suggest you call uscis and place a request to expedite or call the congressman in your area to help expedite. I did place an expedite request and fortunately within 5 days from placing the expedite request my status changed from initial review to CPO

No more "status changes" e.g. f1->h1, L1->h1,even h4->h1 is allowed. Only Extensions are allowed in Mexico..
The USCIS site clearly states :
Who Can Apply in Mexico
* Applicants seeking to renew their visa in any category except B1/2 (tourist/business), if the initial visa was issued in the applicant's home country.
Also Note(in blue font):
Notice: Certain visa applicants may be subject to additional administrative processing. This administrative processing may last weeks, thus delaying visa delivery and the applicant's return to the United States.
I'd rather prefer Canada for stamping(if these rules dont apply there) .

dude take the job if they are offering you a good deal (opportunity does not knock on your door everyday)... its simple as that, you will be in the same field of work your new employer can back you in case there is a "query"
Dont sulk over 6.5 years - they gained as much as you did in these 6.5 years!
