    01/21/2006: Republican National Committee Resolution: Support Legal Immigration & Guest Worker Program, Oppose Legalization

    Report indicates that the Republican National Committee voted on 01/20/2006 to back the Bush's call for a guest-worker program, and adopted a resolution that calls for continued "legal immigration," criticizes illegal immigration and endorses a "new work program for foreign workers," but states there should be "no amnesty for those persons presently in the United States illegally." Read on.
    There are several Comprehensive Immigration Reform bills pending in the Senate. The Senate is expected to return to the Hill next month and the specific agenda for the debate of these conflicting bills have yet to be announced by Sen. Bill Frist. He previously announced that these bills would be tabled for the debate in February. Please stay tuned to this website for the upcoming comprehensive immigration reform debates in the Hill. These bills are expected to bring a reform in the employment-based immigration increasing the employment-based immigrant visa numbers substantially. There are no strong opposition to this part of the comprehensive immigration reform.

    Just wait to see a clear language about EB reforms, and you'll get a taste for the intense opposition. There are several groups very actively working to reduce immigration in general, if not EB in specific.

    We will certainly have a chance to be heard in the coming weeks, but we'll need to be as loud as possible. Join hands and help out now!

    Here is a summary of the bills, their bill numbers and the Sections:

    Sen. Chuck Hagel's Bill (Section 202 of S. 1918)
    -High-tech workers who have worked in the U.S. for 3 years would be allowed to adjust to permanent resident status without regard to the annual employment-based immigrant visa cap of 140,000.
    -The spouses and children of immigrant workers would also be allowed to adjust status without regard to this cap.

    McCain/Kennedy Bill (Sections 601 and 602 of S. 1033)
    -Increases quota on EB immigrants to 290,000 to alleviate retrogression
    -Recapture unused visas between 2001 and 2005
    -Increase the per country limit from 7% to 10%

    Cornyn/Kyle Bill (Sections 1001 and 1002 of S. 1438)
    -Recapture of the unused visas between 2001 through 2005
    -Removal of diversity visa and reallocation of these. Since this is mentioned under EB, the implication seems to be reallocation to EB but am not sure.
    -Increase of the country limit from 7% to 10%

    It is understood that there would be a merging of these to make the final comprehensive immigration bill

    Thanks, but could i still file for a concurrent AOS even though i am currently in the country on a AP?

    As far as I know, FB and EB are completely independent of each other. As long as you can prove that you have been in legal status all along, there is nothings stopping you from applying for AOS based on marriage. However, none of us here are legal experts on such niche immigration issues since there wouldnt be too many of us in that situation; so consult an expert attorney asap. In such matters I would not go by advise on a public forum.

    let's compile a list of famous immigrants like Albert Einstien, Henry Kissinger, Madalene Albright et al and change the face of what constitutes a legal immigrant. We need stories of doctors, scientists, engineers (the success of NASA) who were immigrants and benefited this country. That way we can fight the image of the immigrant as a low wage seeking will work for food kind of a worker being created by anti immigrants. Let Lou Dobbs fight history and deny it.

    Hi Guys,
    I have a concurrent filed application (140 still pending) dated back to Oct 2004 and another I-485 application from July, 2007 from different labor but a recently approved 140. My current EAD & AP is based on the first 485 (Oct 2004) which are due for renewal in next 4 months. Now I want my EAD/AP to be based on July 2007 I-485 (second one) since underlying 140 is approved. Here is my dilema:
    1. When I renew EAD/AP should I check that its renewal or initial application option.
    2. How can I make sure (atleast try) the new EAD/AP will not be tied to old 485 but the new one (will send the new 485 receipt & 140 approval notice).

    Thanks for any suggestions/thoughts you might have.

    As I see it, not hiring the best qualified person (irrespective of his status) is does not make much financial sense.

    Don't you think it is an aspect of socialism to give protection to American citizens, even when they are not the best suitable person for the job?

    That suit will not stand a chance, not becasue it doesn't have legal merit but because it goes to the core of capitalistic system.

    Vonage was just responding to the competition.

    Lingo has a world plan which included unlimited calling to 30 countries( India not included)
    India calls were just 2 cents per minute. I switched to Lingo from Vonage 2 months back. Sensing this mass exodus, vonage came up with an even more aggressive plan.

    Competition is good !
    How is your experience with Lingo customer service. Last year, I tried to switch to Lingo and the lady at customer service is very rude. She is so tired to answer questions and asked me to get all from website. I stopped switching to them.

    just wondering if you have exceeded 5K limit few times? I was told that if some one consistently do this, vonage may review their account. Though they advertise that as UNLIMITED mintues, its in fact not.

    Hi Guys,

    I am pretty new to the forum (as a member), I have been browsing the same for quite some time and found it a good source of information regarding immigration related activities. Right now I am getting removed from my project as one of the top 3 Indian outsourcing firm is dumping their L1 resources at my client site and replacing all the citizens, GCs, EADs, H1 etc. These resources are used in projects managed and controlled by my client (most of them are consulting assignments) and these resources are used on java/.net/oracle projects, these two are violations of L1 visa restrictions set by USCIS, I want to know how and where to complain against this violation and we have all evidence to prove the same (project documents, time sheets, work assignments etc). Please let me know exactly and to which agencies we should complain.

    I am in the same situation, and I plan to include photocopy of my courtesy copy of my I-140 with other docs, as I am filing AOS by myself. If anyone else had the same issue, please share your exp.

    Sorry to disappoint you guys, but courtesy copy is not sufficient to file I-485. Read your courtesy copy clearly. It categorically states that

    "This courtesy copy may not be used in lieu of official notification to demonstrate the filing or processing action taken on this case."

    I think it is crystal clear what INS means.

    The big question is, what happens if you do file with the courtesy copy of your I-140 instead of the original one. My guess is, if you are lucky, INS may accept your 485 petition initially, and after a few months then may simply send you a RFE asking for the original copy of I-140. And, by that time you may be able to convince your company or company-lawyer to release to you the original copy. And if you are unluncky and the clerk at INS is sharp eyed, he/she may take this as a case of missing initial evidence and blow up your entire 485 application at the on set.

    You can take your chances.

    I am all for it, and would support it in whatever way possible. Although not sure how it would work. It would require a gigantic change in the US laws.

    I am here for past 11 years paying all possible taxes. Fortunately i was able to file 485 in 07, thru my second gc filing. Bought a house in '06 in a bold move, with the hope that gc would come thru sooner or later. Overall happy with the move to my own house (though the house value has dropped considerably since). Waiting is really painful, but I'll continue to maintain a positive outlook till then.

    People like you and boreal are doing much better because you decided that a 2 bed room house for rent is what you can afford because the prices shot up by guys like punjabi who wanted to make money and overbid on an house they cannot afford. Otherwise guys like you and many others would have bought house at a resonable price.
    Don't you see what is happening? They live a rich man's life buying house that they cannot afford and then they foreclose with banks taking the hit. The banks in turn gets money from Governement, which they tax on people like you and many others who are renting, so that the guys like pubjabi are entitled to big house and bailouts. This is sick. Where is my bail out money. I want my rent to be subsidized too. I think boreal 's anger is real.

    As I said I am against bailout. As none of these people/organizations should be bailed out. On this issues I resonate with you and boreal.
    But if I am in situation like Punjabi I will think in similar way. I think he has got enough suggestions for him. He needs to decide whether 20k is worth foreclosing.
    On living rich, I prefer living decent in long run than living rich for a few days and then suffering later ..

    Yet, as regular viewers know, the CNN host can slander with the best of them. His latest term of art: �corporate supremacists.�

    In the world according to Dobbs, those are the rich and powerful business interests that are constantly conspiring against the interests of hard-working Americans in the middle class. For the most part, the plotting takes the form of pushing trade agreements and supporting sensible and comprehensive immigration reform. According to Dobbs, those things serve the interests of big business but undermine the interests of the rest of us.

    So wealthy corporations are out to crush middle-class Americans?

    What nonsense. Those are the same Americans that corporations depend on to build their labor force, buy their stock and purchase their products. If these Americans don't do well, our economy falters. And that's not good for corporations, or anyone.

    Nor is childish and irresponsible rhetoric good for public discourse or the country as a whole.

    This is the world's healthiest economy, and a country with just 4.7 percent unemployment. Of course, there is anxiety, as there always is in a global economy with so many unknowns. As the world changes, it's only natural for Americans to feel some unease.

    Shows like Dobbs' don't help. By providing Americans with convenient foils to blame for their troubles � from illegal immigrants to the Chinese to now those dreaded corporate supremacists � Dobbs makes it easy for Americans to escape the consequences of their own life choices. No wonder that message is popular. It's easier to blame someone � or something � for your problems than to do the hard work necessary to solve them.

    Gee, where did we leave that remote control?

    Are you suggesting the fraud should not be reported?

    Its like saying that do not report burglary in your home, as thief may do something bad to the family. Typical scare the victim approach.

    No - I am not suggesting that!!

    What I am suggesting is that the right time to take this up is when a recession is not in full swing. Between 2004 (when this law was enacted) and 2007 was a great time to pick this battle. Maybe another year down the line would also be a great time to pick it. Picking up this particular battle right now would probably make YOUR and MY lives much more difficult in the medium term.

    Like you and the OP - I am a selfish individual. I will pick up only those fights which are in my interest. I believe that this particular fight is a lose-lose proposition in the current climate. I am disputing your (and OPs) belief that this will be beneficial for you/me/rest of us.

    Lets take the example of the same Goldman Sachs manager. Tomorrow ICE comes to him and says you need to get rid of these 50 guys under you. What will he do? He cant increase the budget in the current environment. So he probably will hire a couple of GC holders/Citizens and replaces the whole division (with 50 GC/Citizens besides the 50 'violators') with an offshore team.

    Think about it!!

    Now is the time when everybody is thinking in terms of cost cutting. If you create costly disruptions now - then either the company becomes GM and lose out to overseas competitors or migrates the eitire division out.

    Hard to tell. FBI nor USCIS has ever published demographic information on name checks. Out of 1 million USC and and 1 million or so green cards some of them get stuck in name check. Indians and Chinese don't make up more than 10% of these people yet, most of the name check complaints on the web are from these two groups. It is hard to say if this means these are the most affected groups because many family category immigrants may not be very educated and articulate and may not be petitioning the government and being proactive. So it is very hard to say if one or the other group is more or less affected. You can however look up the below link and form an opinion yourself from the 4000 odd signatures of people stuck in name check:

    Did AILA screwed up the party of many july filers by sending this memo to uscis which scared them and prompting them to come up with the legal proof revised bulletin causing this whole mess. Should AILA had waited until july , then we would probably have a strong legal ground to fight against the uscis ??
