    Hi,

    I am currently in India.

    My Status:
    Jobless
    AP expires on August 10th 2010. Applied for AP extension since April 30th 2010. My AP extension hasn't arrived yet.

    Question:
    There is no way I can travel back to US before August 10th. As per what I heard, a newly issued AP cannot be used to reenter the U.S. if it was not valid as of the date of departure form the U.S. IS this correct?

    Some people are getting an I-94, which will be valid for an year from date of entry!. Does that mean her parole status expires after one year of re-entry. If so, what should I do to extend it?

    I read through the first guy's testimony and all it talks about are the yearly issuance of student visas from FY2001-07. Can you point me to the person who actually talks about EB green cards for STEM students in the US?

    Hi ,
    Does it impact I140 processing if i am outside US and worked with same employer in India ?
    I have left for india assignment after concurrent filing (I 485 + I 140)
    for 4 weeks and joined back in US for different assignment last year after July filings.
    But i have maintained my old residence status and applied for change of address when i came on different assignment and loaction in US.

    Has any one experienced similar situation ?
    Does on US payroll becoming inactive for some duration ( in my case 4 weeks) make the I40 processing questionable ?
    Can anyone advise ?

    As per Spet 2009 visa bulletin, my PD will be current . I recently moved to LA due to Job change . If i do AC 21, do you think i will miss a oppurtunity of getting GC in spet since my PD is OCT 2004.

    Please advise. Should i do AC21 now ? Or Should i do only on RFE?

    Another question. I still have permanent address in chicago but moved to LA. Do i need to do AC11 form?

    I would advise not to file anything at this point (in your situation). Hang tight and wait.

    My father (over 60 years) is coming to the States in June 15, and his B1 visa expires on June 24. However, my father is planning to stay until August 20.

    My question is:
    Will he be able to stay after his visa expiration date?
    In other words, when will his I-94 expire?

    gurus..inputs plz!

    did my first MS, got First OPT ...worked on OPT..didnt find a job..
    went back did my second MS..got another OPT...and moved into non-quota H1 (research field at a hospital)

    now plan to go back and get an MBA..

    1.) will i get an OPT after my (fulltime) MBA??? (as i already have 2 OPT's)...is there a limit of OPTS?

    2.) Since i was a non-quota H1..will i have to apply for the quota H1 when and come out of MBA...which is basically a lottery system now!!! (and if i dont hit the jackpot that will put me out of status immediately after )

    One of my friend is ready to apply for 485. He is all set.

    The problem is he got recently married and his wife's passport and other details are not yet ready and she is still in India.

    Can he still submit his 485 for his wife?

    Gurus, any help / suggestions is appreciated.

    If you just search on word 'wife' you will get the response from thousands of users who posted it. He cannot file 485 for his wife until she is here.

    Dear Fellow Posters

    After 12 months of toil I have finally completed the narrative and evidence that I need for an EB-1a (Extraordinary Alien) application. I ab about to complete the I-140 paperwork to go with it.

    My questions is this - I have contacted a small number of Immigration attorneys who have quoted me approx $6000 for the whole process. How many of you value think that USCIS would look at my application more favourably if I used a reputed attorney rathen than putting in my own application and paperwork ?

    USCIS will be interested in the content of the application rather than the reputation of the attorney submitting it. You are free to submit your own application if you are comfortable researching immigration laws required for your application.
