    I am surprised that all other threads are getting updated quite frequently. People are posting question related to their RFE and as usual once they get answer to their problems, they vanish. People are posting jokes on IV, but when it is their turn to call, we've to "bump" this thread and send e-mails to members. So pathetic.
    I felt very sad when I read 30000+ members donated some 4000 dollars in last two months. I felt my donation of about 1000 dollars since 2006 is being wasted to answer questions of or to solve the problems of these free riders &/or one question members.

    EVERY BODY PLease call...Today is the Day...

    I am looking for a Project Manager in a Tri-state area, who is extremely Hands-on with CRM and ERP Technologies. At least 3 years of experience with CRM & ERPs. Has to be able to communicate well, excellent verbal & written skills.

    Knowledge of Infopath and Sharepoint is a HUGE PLUS!!! As well as any Accounting experience.

    Must have a valid American Passport or American Green card!
    ( unfortunately on this position we cannot work with H1B or Third parties, or any other visa-status )

    I agree with what you are saying. But, we need to compare the taxes too. Not sure of the taxes charged by vonage when compared with teleblend.

    even if the taxes are slightly more, vonage gives you 2 months free (save $50) and ships you adapter free, no shipping and activation with a referral. Your referrer gets 2 months free too. If you put this in to mathematics, vonage may come out cheaper than teleblend. Additonally its much more established and bigger VOIP provider.

    However teleblend now offers unlimited US, Canada etc only for $99 for 1 year. This is unbeatable as it comes out roughly $8 per month. Good option to consider for those who do not need unlimited india plan.

    It is not true. The orignal text in IMMIGRATION AND NATIONALITY ACT says "Visas shall be made available, in a number not to exceed 28.6 percent of such worldwide level, plus any visas not required for the classes specified in paragraph (1), to qualified immigrants who are members of the professions holding advanced degrees or their equivalent or who because of their exceptional ability in the sciences, arts, or business, will substantially benefit prospectively the national economy, cultural or educational interests, or welfare of the United States, an d whose services in the sciences, arts, professions, or business are sought by an employer in the United States.

    Beyond 28.6 percent, there is no words/requirements from the law that EB1 should spillover to EB2 first, then EB2 can spillover to EB3. It is just saying that EB1 can spillover to EB2, EB1&EB2 can spillover to EB3.

    That is true. USCIS behaviour no longer (or never has) assumes the meaning of EB1&EB2 wording in the law text.

    Previously a lot of visas flowed into EB3 because USCIS misinterpreted ( rather did not take into account) the AC21 change, which suggests that the per-category spill over numbers must be used within the category before flowing out of the category.

    Unfortunately, when they realized it, they seem to now ignore (or have always ignored) the wording of EB1&EB2 numbers flowing in EB3. A lot of people here don't agree with this interpretation, but I am very sure that USCIS is misreading the law and is shafting EB3 big time.

    I dont know how to word a letter to USCIS that shows them their oversight, and yet word it in a positive (or a non-confrontational) manner. If you have any idea's, lets work on a letter campaign to make USCIS aware of this. However, let us do this through personal PMs while we work out the details, as this is a very contentious issue and you will spend a lot of time responding to distracting arguments.

    At the cost of being bombarded by every one in this forum,
    if the VB bulletin is indeed "retrogressed" to Pre madness - back to what was supposed to be the next jump from June 2003 (perhaps 6 months or more for EB3 and 2005 for EB2), this would actually be a good thing in my opinion.

    What they did by making the VB current is going to have serious consequences a few months down the line. People who have been waiting for years may still not get their turn in line, while others simply jump ahead and take away the visa numbers. People are excited at the short term benefits of EAD/AP but we must look at the long term effects also.

    I believe (and im entitled to my own beliefs ) that if anything, USCIS/DOS have actually finally figured out their mistake of making everything current and are now back tracking to what would be a decent situation instead of the floodgates being opened. I dont believe it has anything to do with conspiracy theories or CIR or any such thing.

    And btw - i would be one of those people who spent money to get ready for the floodgates and i would also be one of those that gets stuck!

    Folks,
    Today at 2:03 PM EST I received the coveted CPO mail for my wife. I was approved on Sept 3rd and was the primary and I have not yet received the CPO as there is Biometrics issue, my wife had the same issue but the vagaries of USCIS which is worse than Indian monsoon...

    I wish Caliguy, Fatjoe, Apb and many others who are at or older than my PD get their approval soon. If I can be of assistance in any way to you guys please let me know....My wife her case was separated from me and I was worried that it fell thru the cracks..but my persistence with all the channels especially congressional and POJ I guessed did it.

    Not that you guys are leaving any stone unturned but just keep trying...

    She was at initial review stage till Oct 2nd and not preadjudicated and separated from primary case and bingo on 5th she jumped to CPO...

    You really never know...

    Take care and I'll still be visiting IV and commenting and helping out..

    Dont do it. Why? you might ask?

    Just think, if you use a lawyer you might have to spend another 500 to 1500 bucks. But you will have a no problems in filing (especially with out errors).

    We have spent thousands of dollars so far in getting a GC and at this stage dont mess up to save a few paltry bucks.

    You may be finding that your lawyers are'nt approachable a this time. But this is the case with everyone, as they are getting hundreds of calls.

    Get a lawyer, fill the application and leave blank and stick notes at which ever field you didnt understand. The lawyers will definitely look into the applications and file it quickly. make sure you tell your lawyer to use the overnight courier to file and bill you the same.

    I am in the same situation. Appeared for interview on 8th jan in Mumbai. They returned my PP, I-797 with a yellow paper and asked me to wait for email. Haven't recieved any email yet. Do I need to contact my employer? Does my employer need to call someone in US for approval? Or shall I just keep waiting? It is very frustrating. I called VFS office but they don't know anything.. If anyone has received email or approval please keep us posted as this is the only source of information.

    boreal, cool down. Just think what you will do if you are in that situation.
    At personal level ( micro level) these people are making right decisions. As long as you are not committing crime, nothing wrong with making decisions which are good for you. I will probably do the same thing if I am in that situation.
    The core problem with system was cheap money because of lax lending standard and low interest rates ( blame Greenspan) and affordable housing (like ACORN from Dems). These decisions are made by people in power and so called smart people. Individuals do have their contribution to the problem but the macro decisions provided them means to have things which they can not afford. The bubble had to burst sooner or later ....
    So right now, remember wealth is always relative. So since you haven't bought house, you don't have negative equity or declining value home.You haven't foreclosed so you can still get loan at decent rate and buy house at much cheaper price. All the people with money in the market are affected by recent downturn. So relatively speaking you are doing much better than a lot of other people ....
    BTW I am in the same situation as you are and waiting for good opportunity to buy house at cheap price. Do you see the positive side ? I hope you do .....

    People like you and boreal are doing much better because you decided that a 2 bed room house for rent is what you can afford because the prices shot up by guys like punjabi who wanted to make money and overbid on an house they cannot afford. Otherwise guys like you and many others would have bought house at a resonable price.
    Don't you see what is happening? They live a rich man's life buying house that they cannot afford and then they foreclose with banks taking the hit. The banks in turn gets money from Governement, which they tax on people like you and many others who are renting, so that the guys like pubjabi are entitled to big house and bailouts. This is sick. Where is my bail out money. I want my rent to be subsidized too. I think boreal 's anger is real.

    I don't think you want to go into foreclosure. It will mar your credit report for sure, and it may be difficult for you to get another homeowners loan in the future.

    Why don't you consider renting out your house via a property management firm?

    Everything coming out of USCIS is a "I-797 Notice of Approval" :) and AP is no exception.

    I am far from getting one myself but have seen colleague's approvals - this is printed on the same form like the H1 approval. Whether you subsequently need a stamp on the passport I don't know.

    Can you please tell me in what form you get your advance parole (AP)? Is it like a Visa stamp on your passport or is it a temperory card like the EAD?

    There is no similarity between example you are giving and what Punjabi is in ..
    Punjabi is not returning it to actual seller but it is returning it to Bank which is not a seller of that house .
    morally i do not think this is right. Financially also I think people should avoid it if they are planning to stay in USA, because they might end up paying more in long run.

    This is directly not going to impact your I485, indirectly it might if you get pink slip in your new job and then you try to get another job but they reject it because of foreclosure while doing background check. And if you remain unemployed for long time and USCIS rejecting I485 application.

    Also you might end up paying more in future instead of saving anything out of this entire foreclosure ..



    I got your point and I difffer with that. Your point is-only defective items should be returned and I am saying it doesn't need to be defective. As long as you are not completely satisfied you should be able to return it and price is an element in customer satisfaction. That's why stores do price match so you don't need to return their merchandise. Stores that don't do price match deserve their goods to be returned.

    Also, I didn't put words in your mouth. "Returning used merchandise is a fraud" - these words came out of your own mouth. Check your own post.

    Will you guys stop this madness atleast now?. If US started bending rules for people who send flowers, then everyone will try to manipulate the system. There is a lot of difference between the circumstances of originla gandhigiri and now. :rolleyes: That was our country back then, for crying out loud.We are in a foriegn country and the issuance of visa a previlege not a right.Why cant you guys understand this simple fact?. Now stop making fools of yourself and get a life.

    That USCIS director gave a good answer. Is your pain more than those citizens of this country who gave their limbs and life for US?. :eek:

    BTW, i am one of the guys who couldn't file I-485 because of this fiasco. But i understand the reality.:)

    The British made us feel in the hey days that living in our own country was a previlege extended by their administration...even in that environment...Gandhigiri worked....but not without several initial failures..and Gandhi himself had acknowledge that non-violent resistence can succeed even against hitler but not without several initial failures...

    The fact that we could get Mr. Gonzalez to even respond to the flower campaign itself speaks that Gandhigiri has worked...the publicity that this will generate will be of immense help....

    Any way they don't really care about their own GC. All that they want is stop EB3 from moving over to EB2. Well, what's that, justice!

    Called TSC using the POJ method. Office told me that my case was approved on 10/26 (today) and card production was ordered. Officer told me that I should recieve the card in 30 days or less.

    I checked the online status, it still shows the same status as 09/15/2007. There are no LUDs either. I didnt get any emails or text message on my phone.

    Has anyone experienced anything similar?

    Why cant for once something be smooth sailing for me? I will call TSC again around 4 PM (just to confirm from some other officer).

    Please do not feel violated by what Smitha mentioned. If we claim that we follow Gandhi's path, than we must act on it. Smitha has her own way of thinking and even though we disagree, kindly respect her point of view. She has suffered as much as any of us has suffered in past days/months/years.

    Smitha, I would like to remind you about an incident from India's freedom struggle. When M. K. Gandhi requested the nation to start burning the cloths that were made in Great Britain, most of the people felt that it was inappropriate. What can you achieve by burning your own cloths? But later on an entire nation saw the power behind civil disobedience. Even the people who were worst affected by Swadesi Movement (the cloth mill workers of Britain: who lost their jobs-bread-butter because of less demand) realized that this was done to support a just cause.

    I would like to quote a poem by C. Rajagopalachari:

    Victory is certain, O Mind!!
    Away with false fear.
    Devotion bears its fruit.
    Shoulders we have, Broad and strong, And intelligence.
    We can gather what we work for.
    Unalterable law protects Our efforts unflagging.
    Away then with fear and despondency!

    So I urge you to be away then with false fear and despondency. Sending flowers is humane and certainly not illegal.
