i believe this would be a problem. I had a similar mistake(address) on my wife's AP, but the lawyer responded saying name could be an issue but not the address..

During the interview they will ask for photographs, some questions that reflect that you guys are really in a marriage and the flight tickets and amount of time you spend together and then later get your previous paperwork and this paperwork together and then issue a conditional green card for 2 years and later on third year you can apply for citizenship.
My wife is a US citizen and i have applied my green card through her. attended the interview. We live in two different states and often travel to each other place.
Don't worry all willl be fine.
I would really welcome some help with my question! My foreign-born fiance and I would like to be married within the coming year. We are both students (he in CT and myself in MA). Our name is on the lease together here in MA but will we be penalized for living separately when he is away at school? I really appreciate your help, I can't find this answer anywhere! Thank you!!

No problem, because of the work NSC are transferring some cases to Texas. In fact, Texas center is issuing EAD and AP so fast. so your wife will get her EAD very soon.

I could not find anything relevant to "Under Enrollment in the last semester" in the already existing threads including the one you mentioned. The other F-1/ I-485 threads talk about OPT and such issues and not about under enrollment.

Your wife is fine. There is a CIS memo that specifically says that her H-4 status is not employer-specific. The only thing is that she will have a different expiration date to you. She would no get admitted for any longer than her visa, even showing your H-1B approval.

Hello,
You can not (lawfully) re-enter on an H1B, as you're out of status. If you get caught lying at the border, you will be turned back and will likely be permanently barred from entering the U.S. You'll want to re-enter on an H4 visa - you dont need an H4 petition, although obviously you'll need to qualify for the H4, so be prepared to document your spouse's H1 approval and valid status.
Are you stating that you were laid off (thus overstaying), or that you were benched without pay (meaning your employer should have been paying you)? With more than 90 days out-of-status, you may have triggered a period of ineligibility to re-enter the U.S.
Given the apparent overstay issue, I suggest consulting an immigration lawyer.

Agree, too much blue sky. This would be better with early or late light since midday sun doesn't do the clouds justice. Maybe a little more foreground foliage would help too. I'm not sure since I'm not much of a landscape photographer, but I am working on it, and those are some things I'm trying. :)

There are some website that help you to prepare tax return, for example Finalysis.com, myIBSN.com.
These guys are filing 2106 form for claiming employee job expenses and Misc deductions and getting more refund.
In my case my offshore company (in India) has office in NY/NJ and I am working in Georgia state and for whole year 2007 i was working in Georgia state and I had never been to NY/NJ.
In this scenario can i claim for rent/meals/commutation/laundry?
There are many applicants filing through these tax preparer's approx 2,50,000 are these agencies reliable?

Guys,
Making all EB visas current was not the right decision in the first place. That will just shift the backlog from one side to another. The only good thing was interim EAD and AP. When the visa bulletin will come out in mid Sep for FY2008 it will not be too bad provided they have already adjucated 60,000 cases in Jun and would be willing to accept more cases. The dates had already moved quite ahead in Jun 07. In Oct it may turnout to be "C" for some categories and show significant movement for others.
I hope we can still use our current medicals provided it is no later than on yr. we may have to sign the documents again with new sign date.
I am devastated myself but thats all we can do at this point. i really dont think lawsuit will do any good. uscis knows what they were doing. Though all this may help in creating a momentum for CIR, Skill Bill once again.

Hi,
Our attorney prepared and filed our (mine and my wife's) 485, EAD and AP in July 2007.
We received our EAD and AP in 2007 and they are about to expire.
We are currently planning to renew our EAD and AP and wanted to apply on our own this time.
In that context, we requested for a copy of our application forms from the attorney.
We never got to verify the filled application forms until now (the attorney sent us only the pages to be signed at the time of filing)
To our surprise, we figured out the following mistakes in the application forms:
1) My I-94# in 485 and EAD application forms was wrongly mentioned. But I had my A# correct and it matches with the one on my EAD.
2) My wife's date of last entry in US was wrongly mentioned in 485 and EAD.
3) My mother's name was misspelled (a letter was missing from her first name)
I am not sure how bad the above mistakes are.
Here are my concerns now:
1) Are I-94# and last entry date used during namecheck or any other phase during the overall process? We didnot travel outside US since we applied 485. What if we travelled (the I-94 and last entry dates would have anyways changed).
Do we need to update these details explicitly after every travel? How important is it to get these details corrected in our applications?
2) If we apply for renewal of EAD and AP with the correct details this time, is it going to be fine? Do we still need to get them fixed in our 485?
OR
Will it be a problem for renewal because the details are different from the original application?
3) What is the procedure to follow in this situation?
Any advice in this matter is greatly appreciated.

If you are in a project and your client is ready to give a letter stating abour your employment on the project , there won't be any problem.

On this case, I am getting mixed anwsers
Employer's lawyer is saying that i can continue to work since have valid I-94 and they are going to appeal. Lawyer called USCIS officers and USCIS officers confirmed this ( !!!).
Second lawyer is saying that i should stop working on denied petition.
Once you apply for appeal or motion your H1B peition status changed from 'Denied' to 'Pending' and you may continue to work for employer. - this is my guess
In fact, I am planning to get advice from murhty too...
Any thoughts on this.
