I am a labour substitution case pd feb 2002 filed 140 in June at NSC. My 140 has been pending for more than a year. Now recently I received 2 year ead.
Does this imply my 140 is approved too???
Is it safe to work on ead of one gets 2 year ead with pending 140.??
please advice.
I do not understand why they grant EADs when your I-140 is not approved. The reason I bring this up is if a person loses his/her job and your I-140 is revoked, the EAD is useless. You cannot use AC21 for that because your I-140 is not approved.
Nebraska center is doing nothing regarding I-140 EB-3 (India) apps. The I-140 date at Nebraska has beeing moving by 1 day per month for the last 7-8 months. It is stuck at March 30th 2007. Moreover, the latest "as of" i.e. "report" date that you see on Nebraska is July 31st 2008. It is not current (Sept 2008) as many of you may think.

Employer cannot withdraw your I-485 without your consent and signature, notwithstanding G-28 form.

I have my H1-stamping and I-94 valid until March 07, My H1 extension was applied during Nov - 06, but not approved yet....In the mean while, can I visit India and return by Feb 07 ? On my return, I will still get my I-94 till March 07, but Once my H1 extension is approved it will have the I-94 attached to it till Mar 08, is this I-94 valid ?
My employer is saying that, the new I-94 that I got from my H1-extension is not valid and they have to file a new H1 OR I have to convert the H1 extension to Premium and travel with the approved H1 extension ?

While travelling on H4, IF she gets her H1 Approval she can get the same stamped in the overseas and travel whenever even after oct 1, No issue with that.
Now on the other hand if she travels back on H4 after oct 1 which is the start date of H1 that may override the H1(Not sure consult appropriate attorney)

The text is printed on your SSN card based on your visa status at the time of application. EAD is also a temporary status, this also requires a renewal. Hence, you would not be able to "remove" the text from your SSN card until your receive the GC.

Washington DC has declared Sept 18 as car-free day encouraging commuters to leave car at home. For details see link below:

it took 45 days for the cheques to be encashed for the EAD application when I sent it to the Lockbox facility. I beleive they receive the mails in one location and forward it to the appropriate center.

As per my lawyer (one of the best) returning based on AP does not invalidates your H1B status. Your wife can get H4 stamping based on your current H1B approval, although some consulate might create issue as you don’t have stamping in your passport (this is rare case). Again all this coming from best lawyer not me.
Once she has H4 she can enter on H4 and you can enter on AP.

Hi, Today my I485 had a LUD and when I check the status it is saying:
Document mailed to applicant.
On October 24, 2007 we mailed the document to the address we have on file. You should receive the new document within 30 days. If you do not, or if you move before you get it, call customer service.
I already received everything and went for FP 20 days ago. I missed the appointment and then went the next friday and they took the prints. I was told that I didn't need to reschedule the FP. I had the LUD after the FP date too.
I have seen that someone had this same status but did anyone ever receive nay other document in mail?? IF so what is it???

I think this is a step forward...but aint cutting it...your status remains "in process for years"...everyday check the same url and it says gives the same stale status...what we need is a way to make a resonably accurate guess as to when my LC will go into the next stage..

I'm sorry to hear about your mom's situation.
Obtaining the green card doesn't mean your mom has to come here immediately. She can attend the interview and choose to come at a later point. I'm not too familiar with the appointment process/wait times etc but it seems like a lot of hassle to have to reapply.
Is postponement of the interview a choice?
I dont know how long ago you obtained your green card or citizenship but these days it's a loooooooooooooooooooooong wait for the elusive GC. So grab your chance when it comes.
That was my two cents.
