Hi,
I graduated on May 2008 with an MBA degree. My OPT started in Jul 2008 and is valid till Jul 2009. I am not eligible for 29month extension.
I was on an internship till Jan 30th 2009 and am looking for fulltime positions now.
I understand that I will have to file for H1 on April1st and I can stay in the US and work legally if my H1B is still in process under the cap-gap rule passed last year.
How long can I legally stay in the US on OPT without a job?
Can anyone please throw light?

I read a few of the comments and quickly realized that its just trash
I refuse to post a comment when the caliber of people commenting on there is so low that they will gain nothing from my comments and only possibly use it to spread more hatred.
All they are doing is openly showing that they have no intelligence and are not worth the attention they get.
Why bother to comment when they can't finish a proper sentence without abusing. I got better things to do.

I got GC under EB2, I'm planning to start my own business. is there any risk factors if i leave my employer right after getting GC and change the Field of intrest?

For past few months I hear some noice on the web that USCIS may be changing its policy soon by discontinuing Concurrent filing and allowing people to file I485 If I140 is approved irrespetive of visa number availability. How far this is true, have any body got more details on this ?? :confused:

It was a nightmare for few weeks but, long story short...I got my new passport after the Embassy cannot find my original I sent for renewal. Please let me know if I need to get it stamped within any timeframe. My current I-797 expires MAY 2010. I have an approved 140 and EAD but my attourney suggested to stay on H1B.
Appreciate your feedback and help in this matter.

You dont need a visa stamp on your new passport unless you want to use it to re-enter US when you travel. There is no time line associated with getting a visa stamp. You just need to make sure you keep extending your H1 status and get an I-94 with the extension approval. If you have an AP you can use it for re-entering and still can continue working on H1 for the same employer. Else, when you travel the next time, you can setup a visa appointment and get H1 stamped on your new passport.

This means they have recived your Evidence and the processing has been resume. I donot know if you are victim of A#. Same A# assigned to more than one application(I read it somewhere)

also try taking appointment by sending someone to the mumbai office. only a portion of the appointments are available on the internet. you can get a better date by taking a local appointment. it can be taken anywhere where there is VFS office (pune etc) if mumbai is not a convenient place for you. this was the case around 3 years ago, i dont know if it has changed now, but worth exploring the option.

If your employer fully support you on your entry into USA after long stay in India, you are good.
You may need to show documents, letter from employer, and also he will be ready to answer phone upon entry. (they may ask him whether a job is available for you).
You can enter before your visa expiry.
Talk with company lawyer.

SDI is disability insurance you are mandated to insure during this kind of situations.
My wife is working on EAD. When we had baby (she had C-Section), she applied for SDI and she was paid. She asked her HR. HR mentioned SDI is nothing to do with immigration. Due to the company policy, We were forced to apply.
I know one of my friend who was benifitted with SDI and FMLA while he was on H1.

Hello,
I have a H1B visa stamped on my passport for Company A. This visa is valid till Nov 2008 and will need renewal after that.
I recently changed my company from Company A to Company B. They have filed for my H1B transfer.
Question 1] Will this new H1B for Company B be valid for 3 more years (Till Feb 2011) or will this visa have to be renewed in November 2008 (remember by visa stamp for Company A is valid till Nov 2008)?
Question 2] What if I want to travel to India this October (remember by visa stamp for Company A is valid till Nov 2008)?? Can I still travel on my old visa stamp or will I need to go to embassy again in India for a new stamp

Thank you for the reply. My confusion stemmed from whether i can use my US License as my id for gaining the license. Or whether somehow my A# or I94 number had to be noted on the license/certificate in order to use it at a later point for the green card process.
Most states require birth certificates, proof of citizenship and/or residence, and a driver's license or other photo id. You need to produce your immigration documents depending upon the State
