    vengaiah: Fill the I-9 form and send it to your company B with a copy of your EAD, fill in the direct deposit form ( or take cash :) ) and you are good to go.

    You will have submit a new I-9 with a copy of your EAD to your company A - as your will status will be "Pending AOS" from the moment you start working for company B using EAD and You are no longer in non-immigrant status (H1B).

    I'm a July 2007 filer going to file for my EAD for the first time. Since I'm currently on H1B, how should I answer this question

    I'm applying for:
    a) Permission to accept employment
    b) Replacement
    c) Renewal of my permission to accept employment

    I think I need to go with option "c" since moving from H1B to EAD would qualify for a "c" response

    Please advise.....

    So the letter is just an employment continuation or verification letter and has nothing that states the spousal details or spouse's intention to accompany the H1 holder. I hope I got that right.

    Hi ,

    I'm on H1B. Recently I joined new employer and the transfer is still in
    pending status.
    Among the documents required to sponsor for B2 visa, I'm supposed to
    send copies of I-797 and I-94. I have old employers H1B approval notice
    and I-94, but not of the new employers. I have the H1B receipt notice
    related to the new employer.

    Is it fine to sponsor for a B2 visa and for the visitors to attend the visa
    interview in the US consulate with all the other essential documents
    including new employers H1B receipt notice without the new employer H1B
    approval notice.

    Any of your valuable suggestions are welcome.

    Yes, it can be done. Basically, you have to show that the work experience is at least the equivalent of a College degree. There are people, called "evaluators" (or something like that) that analyse all the credentials and work experiences to determine that equivalence. Immigration attorneys know how to use those "evaluators" whose "evaluations" are usually accepted by USCIS.

    I would say 30 days after August 23 since that is the latest advert you ran for the job.

    Thanks for your reply. One of the newspaper ads ran on July 27th. Does that mean I have to wait 30 days from that date?

    I have 4 additional steps when DOL needs only three. May be I do not have to count the University Alumni Placement ad and file early.

    Below is my info and kindly let me know your thoughts

    My Current Status: H1B
    EAD start date: 1st Nov 2007 (Didnt start using it yet)
    Occupation Title: Computer Software Enginner
    OES Code: 15-1031

    New Position: Sales Consultant
    For the Sales consultant position the description is much more technical and macthes 50% with whats Computer Software Enginner.

    1. What are the immigration steps that need to be considered for the portability(AC21) ?

    2. If new corporation says we cannot do the portability because of say OES code or something else what are the options to still take the job ?

    Hello
    Whm i transferred my H1B to another company, i missed filing filing for H4.
    So she was having I 94 of my old company till Nov 2006.
    Whn i changed company agn in Dec 06, thats whn i relised her i 94 expired, we submited I 539 for her xtension. but couldnt get it. she exited the country before 180 days of her expiration and planning to apply for new visa in India.
    Did anybody had the same experience. Pls share.
