    There is one way to find out if CIR is any good for EB - by looking at the bill when it is proposed bill and amendments. It will be suicidal to assume that CIR is somehow bad for us, and incriminate any effort for CIR. My point earlier was not that CIR is bad for EB, but about the actual reason for Sen. Reid's recent comments, just to set the expectations straight.

    It depends on how many cases that will be pending approval on October after the surge of applications this July and August.

    I think it wouldn't be current for some countries specifically India and China.

    I have 2 H1B Transfer questions for clarification.
    1. Can H1B Transfer be filed when H1B Extension is pending with the current employer?

    Yes, a transfer could be filed while an extension is pending. This is the so-called anchor transfer. However, the transfer would be denied if the extension petition is withdrawn before the transfer is approved.


    2. Do i need to have copy of I-140 approval notice for H1B Tranfer? The current employer does not share this document.


    The 140 approval notice is not required unless this is a post six year transfer/extension.

    I have not heard any schedule for these bills. There was a hearing last week, but I couldn't find the outcome of the full hearing. May be someone from IV Core can tell us what is scheduled for the coming days.

    You will not jeopardize your I-485 as long as job with company C is in same or similar occupation. Whether USCIS will grant an H-1 3 year extension based on a withdrawn/revoked I-140 is not certain. I outlined the reasons for this uncertainty in my response on the thread entitled "Facing Layoff---6 months left..."

    So in short, B to C H1 transfer/extension is usually not possible if I-140 is revoked.

    you can get only one OPT per level of study
    ie., one OPT for under-grad
    one OPT for grad
    one OPT for doctoral

    So I doubt if your wife will get another OPT with the new rule but you never know :-)

    Hi All,

    Need some comments on my situation. My lawyer filed for my I-140, I-485, AP, and EAD on November 20th on EB2 Row Category. I just emails yesterday stating that my EAD card is sent to production, but they have asked for initial evidence on 485. Is it possible to review 485 without looking at the 140? I am not sure what that query is, but really hoping that it is not something serious. I've already waited for 16 months for my Labor to get approved. Please share your experiences, suggestions etc. regarding this.

    Why do the senators not do somthing of this sort .Everything seems to come from the House . If the House is so concerned about the helping EB folks . They must act now and first veto the increase in fees for H1B visas and secondly propose amendments to the Nursoing Amendment to help EB applicants .

    I am a labour substitution case pd feb 2002 filed 140 in June at NSC. My 140 has been pending for more than a year. Now recently I received 2 year ead.

    Does this imply my 140 is approved too???

    Is it safe to work on ead of one gets 2 year ead with pending 140.??

    please advice.

    I do not understand why they grant EADs when your I-140 is not approved. The reason I bring this up is if a person loses his/her job and your I-140 is revoked, the EAD is useless. You cannot use AC21 for that because your I-140 is not approved.

    Nebraska center is doing nothing regarding I-140 EB-3 (India) apps. The I-140 date at Nebraska has beeing moving by 1 day per month for the last 7-8 months. It is stuck at March 30th 2007. Moreover, the latest "as of" i.e. "report" date that you see on Nebraska is July 31st 2008. It is not current (Sept 2008) as many of you may think.

    I understand that they receive 1000s of applications but that is no excuse for incompetence. As of July 31st, it was taking them 1 year and 4 months and now it is 1 year and 6 months to process I-140.

    Why don't they re-institute expedited I-140 approval?

    Can IV please help us?

    Hi

    I have been on H1 for 4 years in the US and left the country last november voluntarily due to personal reasons. My H1 is still valid till next year september. Now that I have over the "365" days rule... my employer propositioned me to come back and work for them. My question is :

    If I apply for H1 after november would USCIS consider this as a fresh 6 year period starting next year?

    Second - If I apply for H1 after november will I only have 2yrs since I have not completed the six year period. If so, what is the solution after coming back to make use of the six year period.

    I hold an MS from US, so I would imagine that I fall under the Advanced degree Cap of 20,000.

    Please post some feed back people.

    Sir/Madam,

    I was able to file for 485 during the summer of 07, have an EAD but never used. I got married later, and my spouse is currently on H4. I have to maintain the H1 to support the H4. I have a very good opportunity to move up in my job - Is there a way use my EAD and still support legal stay of my spouse?

    Appreciate a response.

    Under certain circumstances, your International Student Advisor can grant a leave of absence for one semester for you. You need to get some paperwork from a doctor which will state that you can't attend college and why and for what reasons. However, this is not an easy case. Secondly, once you husband applies for I-130 based on marriage, this may violate your F-1 status as F-1 has purely non-immigrant intent and by filing I130 you show you intend to immigrate to the U.S.

    I tried to help my friend to transfer to another school when he was on F-1. A month after he transferred to the new school, the IS Advisor told him that his F-1 status has been canceled in the SEVIS system. Later, through FOIA he learned it was due to I-130 petition filed by his wife on his behalf a few months earlier. Conicidently, they canceled his F-1 just after the I130 approval. Luckily, his wife became a US citizen just few months later and he adjusted status due to that.

    I always advise to speak to an immigration attorney before taking any action. Thank you.

    Hi,

    I just became unemployed (today) but I obtained my GC through employment about 2 years ago. I have some questions:

    I am planning to spend about a week or 2 in Canada, will that cause me any problems when I come back to the US? I will keep job hunting in Canada but for a job in the US as I intend to stay in the US.

    Am I entitled to unemployment benefits since I have a GC?

    Will my layoff create any problems for me when I want to become a citizen of the US in about 3 years?

    I came in US with my family when I was 15-16, back then we were on L2, then as time passed by we switched to H4. Then I turned 21 so I had to go on Student Visa (F1). Still living in US legally.

    Now my question is I've been staying in US over 10 years now, legally. I dont know if its rumor or not, but someone told me, that you can apply for Green Card if you lived in US over 10 years legally, is that true?
    Going through all that H1B process sounds really hectic. Also all my family members, friends and relatives are here, I don't know anyone back in my birthplace. any suggestions or tips, would help a bit.

    Idea is good. I doubt we would get any information out of them.
    Unless this is done with mass media coverage, like CNN, MSNBC, FOX for a week.
