Hi All,
My LC was approved recently(PD June 2004). The location/office for which my LC was initially filed was closed recently.
My company(which has offices all over states) has another locations/Offices in the same metropolitan area.The company attorney is saying that they can use my approved LC to file my I-140(and I-485 concurrently) for another location in the same area as long as it is within commuting distance of the original location.
Was wondering if anyone knows about this?

The wages for Labor Certifications are determined by MSA(Metropolitan Statistical Area), so as long as the new location is in the same MSA, there should be no problem.

Does anyone know what email / letter(s) one should get when the GC is approved ?
I received this email two days ago:
On November 13, 2006, a welcome notice was mailed for this case. If 30 days have passed and you have not received this notice. Please call the National Customer Service Center at (800) 375-5283 during business hours.
Does this constitute as a GC approval ?
I read in other threads that a "card ordered" email follows the GC approval but I haven't received the email (nor the physical card yet).
Does it normally take 1 or more weeks for the physical card to arrive after approval ?

I applied on July2nd, I got the receipts on september7th and FP for oct23rd but no EAD yet! I have seen most of them get EAD but no FP, Does it matter which comes first should I wait sometime after FP for EAD?

Could this be the administrative fix that IV is working on - which pappu replied in another thread.
Can we please get this so that people can add spouses (if they did not do so during july fiasco).
I think he mentioned that it is for I 485 applicants and to me I 485 applicants are who filled AOS. Poor me (:

I am planning to schedule a visa appointment soon. I was filling DS-156 form
and have a following question:
Item#36 : "Has anyone ever filed an immigrant visa petition on your Behalf?".
Here is my situation:

Myself -> H1B
My wife, kid -> H4
Applied for I-485 last year ( all 3 of us ).
Question:
For me, I understand that I say "yes" and mention name of my employer.
But for my wife+kid, I say "yes", but what should I fill for "who" part?
Also, Item#33 for my kid (2nd grade), should answer to "Do you intend to study
in US" be YES or NO ? ( my guess is YES, and name of the elementary school?)

Hi all,
I submitted an application via premium processing for EB-1a with USCIS at the Texas Premium Processing Centre last month (April 2007).
I received an RFE notification via letter after two weeks listing the requirement of further evidence against 3 out of the 8 criteria I submitted.
I can submit further evidence - but my question is this ... "Why have they not made mention of the other 5 criteria I submitted" ? Has this failed ? Do they not matter ?. I am quite concerned because they have not made any mention of my other criteria ? Does anyone have any advice.

Thanks for your reponse Panky... I filed my I-140 cocurrently with I-485 with NSC but it got transfered to CSC ...CSC is not even publishing I-140 processing dates.. Wondering if CSC is processing I-140's... I believe that NSC and TSC has sole jursidication over I-140 adjudication.

i'm above 21yrs old and on f1 status ..my question is
My sister is citizen here and can file family based GC (to get it would take 10yrs miin)
1)for me to maintain legal status i have to move into h1 status later on..will the Family GC process affect in any way to get h1 later on?
2)Do i have a chance to file GC later on under EB2,or are 2 GC applications not accepted(just curious)
Please post your thoughts attorneys

Can anybody tell me what is the logic behind writing "DO NOT OPEN IN THE MAIL ROOM" on envelope while re-submitting I-485 appplication?
I will need to send to USCIS today. Please let me know ASAP.

AgJOBS, which combines an earned legalization program for farmworkers with a reform of the H-2A temporary foreign agricultural worker program demonstrates a successful model for compromise where workers and employers have come together to resolve their differences. The dysfunctional U.S. immigration system is currently standing in the way of addressing deeper structural problems that impact U.S. workers and U.S. competitiveness in a globalized market. As Congress proceeds, here are a few facts about the current challenges at the intersection of immigration policy and agriculture, and why addressing these issues is critical to the nation�s economy.

I transferred my H1B from Company A to Company B. Currently i am working with Company B, but my Company -B's H1B Application is Still in Pending.
Now i would like to do the COS from Company B(pending H1B) to F1 as I already received I-20 from the University for the Spring 2010.
Case Description: Assume that, we applied Change of Status from H1B to F1 and it is in pending status.
Case i : what happens to my Pending H1B Application with the Company B.
Case ii : What happens if my H1B with Company B gets approved/Denied, when COS from H1B to F1 is pending.
Case iii: what happens if my H1B to F1 Change of Status gets denied.
Appreciate your valuable answers.

i have working on h1b with compant A. i got a job offer from company B ( a consulting company) for a third party client. i sent company B my H1b tranfer papers . i didn't signed any offer letter or agreement with company b till now. company B filed LCA for me and before they field for h1B transfer , i changed my mind and informed company B that i am not going to join them. now company B threatning me that they will sue me for the damages and fees they spent and put a stay on me so that i can not work for any other employer while the case is in court of law . i have all my personal and other information with them as i sent them all the documents for H1B transfer. there is no offer letter and agreement signed between us and it was only verbal communication apart from some E mail exchanges and documents sent for transfer of visa. any body please advice does company B can create any problems or file any suit againt me . what are my rights ? i am still working for company A and don't want to get into any trouble..

I was more inclined towards 2nd option thinking that whether or not I get I94, if in case I have to use it, I can make a trip to India and get the stamping done?

Hello,
Could anyone please suggest me a few consulting companies who can sponsor H1B visa? I am trying to bring my friend who is in India working for an automotive OEM. He was in Michigan for a while and he went back to India and it�s been almost more than 7 years since he left but now he wants to come back to Michigan.
If anyone knows any consultants in Michigan would be perfect since I already have a job lined up (verbally) through my contacts but I am not successful finding an employer who can sponsor H1B for him.
