Dallas-Fort Worth Immigration Lawyer Has Just Posted the Following:
Effective January 4, 2010, the U.S. Department of Health and Human Services, Center for Disease Control and Prevention (HHS/CDC) is removing HIV from the list of communicable diseases of public health significance and references to HIV from the scope of medical examinations for foreign nationals.
Until the rule goes into effect, non-citizens who are HIV-positive cannot be admitted into the U.S. unless the U.S. Department of Homeland Security (DHS) grants a waiver. Once the rule goes into effect on January 4, 2010, HIV infection will no longer be defined as a communicable disease of public health significance, immigrant visa applicants who are required to undergo a medical screening exam will no longer be tested for HIV, a waiver for entry into the U.S. will no longer be necessary, and HIV-positive visa applicants will not be found ineligible for visas under Section 212(a)(1)(A)(i) of the Immigration and Nationality Act (INA). Although foreign nationals with HIV who apply for visas will no longer be ineligible under INA Section 212(a)(1)(A)(i), they still must overcome the public charge under INA Section 212(a)(4) by demonstrating to the consular officers that they will have the means of support in the U.S. and that they will not need to seek public financial assistance. Hi folks,
I am on H1B visa currently, set to expire in two months from now (end of September). I need to get my H1B renewed for the next 3 yrs. Due to unavoidable reasons my lawyer has not been able to file for the renewal yet.
My questions are -
1. Do I need to have the approval notice before my expiration date?
2. I plan to travel internationally in November. Would the receipt notice be acceptable to reenter? Or do I need the approval notice?
Any suggestions are most welcome. Thanks in advance.

Hello all,
For past few months I hear some noice on the web that USCIS may be changing its policy soon by discontinuing Concurrent filing and allowing people to file I485 If I140 is approved irrespetive of visa number availability. How far this is true, have any body got more details on this ?? :confused:
there was a proposal a while ago to stop allowing concurrent filing, but I have only heard about filing of 485 without an I-140 from people who wish for that, nothing from USCIS.
Something like that requires a change in the law, its not a matter of USCIS policy

No you do not need an airport transit visa if you are travelling via Germany by Lufthansa using ur AP. Until and unless you do not change terminals it should be fine and all lufthansa flight arrive/depart from same terminals.
I just returned yesterday using my AP and I traveled via Munich.
You will be asked for your AP at immigration in India as well as while transiting in Germany..

Hello guys,
I came to US to pursue masters, and have started working on H1b while working on my thesis in parallel. Meanwhile my advisor did not get his tenure approved, and had to leave the university. So I had to abandon my thesis work, and had to register for extra courses. My employer and the client I work for are okay to let me go to university for 2 months, but my employer did not pay me for the period (no paystubs for this period). So my year-end wages fell short of the LCA amount.
I know that unpaid leave is not legal while on bench, but since I took the leave while I was actually on a project, does anybody think mine is a genuine case, if there is any such thing??
I am looking to go for stamping, and is really urgent

Just get a letter addressed to Consular Office, US Consulate , City ( where your wife is scheduled for interview) . In the letter just mention in subject line "request to grant visa to spouse of Mr XXX" and in body just mention the details like Mr XXX is working with us since DATE As DESIGNATION and his salary is $XXXX. We request you to please grant his spouse Mrs XXX H4 visa so that she can join her husband in USA.

Now, can I take up a job with a different title - say, "Finance Analyst" or "Corporate Finance"? I have been talking to various clients in California that are interested in offering me finance positions.

You are not alone. I will be joining the same pool. In fact, I have already served a notice and would be leaving this company of mine on the same day on which I will be flying to India. I do not know if there will be any issues of it while coming back on AP but I would have already passed 180 days well before it.

HI all,
I would like to have your opinion regarding my spouse visa, I applied for H1B visa in Cairo Egypt. I'm a female IT pro and got the visa with my 2 sons 5-2 years old. My husband was not given visa, VO never asked him any question and just stapled a paper to his passport to track his visa status online. I asked VO wheathre that means my husband was rejected, she said no just some delay, it takes some cases more time.
it has been one month since I did my interview in the consulate and nothing updated on that web site. My husband has his sister in USA with Green card. What do you think the situation will be? is it rejection or wil get visa later?

I am new to this forum. Just registered myself. I hv a question if u guys can help. I got an RFE for I485 for employment verification. Lawyer says he sent the employer verification letter with his signature instead of employers bec employer has given him authorization to do so. can anyone do like this. does this pose a problem for my I485 approval. Please help.

Maybe USCIS would earn more income by telling the illegal immigrants to file EAD/I-485/Biometics every year etc.. Immigration attroneys would earn good money by replying to RFEs for 12 million immigrants. Getting this 12 million illegal immigrants legalized will surely improve the economy.

How difficult would it be to work with the USCIS dept to "allow" filing of I-485 stage on a continuous basis when priority dates are not current? In the current scenario they are pre-adjudicating cases up to July 2007 and are allocating visa's number to them as and when DOS makes them available. They can might as well allow a continuous filing of 1-485, pre-adjudicate them, and then we can wait when DOS gives the visa numbers to get the GC. On the USCIS side of things they will at least reduce their deficit, from fees for i-485, EAD, AP, Renewals. On our side we get the EAD which eliminates employer dependency, visa stamping, visa renewal, proving employer-employee headache. This may sound like a baby step to streamline the GC process. Will this need any type of legislative effort? Is this possible?

There is a requirement for me to take up another position with the same employer (sort of Lateral job transfer) with the following details:
My H1B is sponsored by State Government who I have been working for 6+ years.
PD=DEC 2002, EB3
485 Filed= JUNE 6, 2007
FP = JULY 17, 2007
The new position will be with:
Same Employer
Same Job Title
Same Job Description
Same Job Duties
Same Pay
Same Classification Code (internal state job code#)
Same Supervisor
Same Location physically same cabin
Same everything else I can think of.
ONLY THING DIFFERENT IS THE "POSITION NUMBER" that is assigned by the Personnel Department. There will be an internal advertising for the position and interview & selection process.
I would like to know:
1) Does accepting the position at this stage cause problem with the Green Card process, i.e, will it affect my I485, PD or anything else? I have waited 6+ years to get to this stage and obviously I do not want to take any kind of risk.
2) Do I need to inform or check with USCIS or any other agency about this position change?
3) Do I need to do anything else to protect my PD, AOS etc.
I would appreciate all the assistance I can get.

So all we know from this is EB3 ROW has not progressed much. Does not make for a good prognosis for EB2/EB3 India :( .
