It's really impossible to answer this without knowing the exact employment relationship that is planned and what the denial said in detail. Presumably your employer has a lawyer who can advise on whether an appeal might be successful. It is very likely that the denial was based on there not being the correct "employer-employee" relationship. CIS issued a new memo on this last month, and there are many threads in this forum on the topic. Technically, you can do that. But it's better for you to transer your case to consular processing if you are not planning to be in the US for a couple years.
I forget to mention that it is for my wife. she is my dependent with EAD and AP. i know if she have green card she have to stay 6 months in usa. it that applies to EAD and AP also.

I am planning to use AC21 by joining a company on this March month end , I asked new company to process H1, and its in progress.
In APRIL Visa Billiton my PD is current, as I have PD of JUNE 2001( EB2), my RD - JUNE 29, 2007 .at this stage if I change company what is the impact on my GC approval. Should I wait for some more time to join the new company?

I came across a posting today for a local contract position, which was a good match for my profile. But when I sent my resume in, the vendor said we cannot proceed because the end client asked for either citizens or GCs. I thought it was strange, because it is a contract requirement, not fulltime. This is the first time that I have encountered someone requiring a GC for a contract posiiton. Further, this is not a defence or state department kind of deal where you'd need citizens. I would understand if they said 'citizens only', but GC or citizen does strike me as unconventional.
Can someone please advise if this is allowed by law?

I dont know your exact visa background, but why do you want to use EAD, it is always better to stay on h1, if you are planning to shift employer then do h1 transfer. There are lots of threads explaining the pros and cons of using AC21 and switchin to EAD etc... but the safest way is to stay on h1.
If you can then i would suggest staying on h1, if you are shiftin employer talk to new one to ask for h1 transfer...

My salary in 2011 has been raised by $20K per annum, from what it was in 2010.
Will this have any consequences on my next H-1B renewal OR if i go for visa stamping OR on the PERM application?
Mine is a small company with just 12 employees and I hold the same position as I used to when i sarted. I just want to know if there would be any issues with this on any stages.
Your replies would be appreciated.
It's no problem at all if you make exactly the same amount as mentioned on your H1B petition or if you make more than that. It never is an issue to make more $$$$$$. Make hay while the sun shines.:D

The Conrad 30 J1 waiver program has been extended to September 09.
I believe IV core has been actively pursuing the Conrad 30 Improvement act. Can core please update us regarding the chances of this legislation passing in September 09 ?

You should have asked before filing for an extension or do a search at USCIS Home Page (http://www.uscis.gov) you would have come across the below:

Hi Guys,
I was reading another thread and a question came to my mind..
I entered in US on AP and got the I-94 with the validity date as my AP date. Now my AP is going to expire and I am not going to travel anywhere any time this year. So just wondering what will happen when the I-94 is expired. Do I have to get it renewed from somewhere or just dun worry about it. or do I have to apply for a new AP.
Can anyone can shed some light on this situation?

1) My manager (CEO of the company) and the person I will work under (From the client company) is different.

There's no point however about my qualification and experience (I have a degree from IIT and work at India branch of one US multinational). The company says that they have a number of approvals this year and the particular decision depends on the officer at USCIS to a large extend. They can re-appeal addressing all the concerns mentioned by USCIS.
How much are the chances are that a denial would be converted to approval. Is the USCIS going to be very strict and judgmental about the re-appeal of the denial?. May be it is hard to tell, by I greatly appreciate any help/suggestion...

Assuming you meet the requirements for E visa status as an employee and not an owner of the company, this is a viable strategy.
